Artikel 1 – Definitioner

I disse vilkĂĄr forstĂĄs:

Fortrydelsesfrist: Den periode, hvor forbrugeren kan gøre brug af sin fortrydelsesret.

Forbruger: Den fysiske person, der handler uden for erhvervsmæssig virksomhed, og som indgår en fjernsalgsaftale med Fluxidi.

Dag: Kalenderdag.

Langvarig transaktion: En fjernsalgsaftale, der omfatter en række produkter og/eller tjenester, hvor leverings- eller købsforpligtelserne er fordelt over tid.

Varigt databærer-medium: Enhver enhed, der sætter forbrugeren eller Fluxidi i stand til at gemme oplysninger på en måde, så de kan tilgås og gengives uændret i fremtiden.

Fortrydelsesret: Muligheden for forbrugeren til at ophæve fjernsalgsaftalen inden for fortrydelsesfristen.

Virksomhed: Fluxidi, den fysiske eller juridiske person, der tilbyder produkter og/eller tjenester til forbrugere via fjernsalg.

Fjernsalgsaftale: En aftale, der indgĂĄs som led i et system organiseret af Fluxidi med henblik pĂĄ salg af produkter og/eller tjenester udelukkende via fjernkommunikation.

Fjernkommunikationsmiddel: Et middel, der kan anvendes til at indgĂĄ en aftale, uden at forbrugeren og Fluxidi er til stede pĂĄ samme sted samtidig.

Almindelige vilkĂĄr: Disse generelle vilkĂĄr fra Fluxidi.

Artikel 2 – Fortrydelsesret

Forbrugeren har ret til at fortryde aftalen inden for 30 dage uden at angive nogen grund.
I denne periode skal produktet og emballagen hĂĄndteres med omhu.

Hvis fortrydelsesretten udøves, skal produktet returneres med alt tilbehør i original stand og emballage, hvis det med rimelighed er muligt, efter klare instruktioner fra Fluxidi.

Artikel 3 – Anvendelse

Disse vilkår gælder for alle tilbud fra Fluxidi og for enhver fjernsalgsaftale mellem Fluxidi og forbrugeren.

Før aftalen indgås, gøres teksten tilgængelig for forbrugeren på et varigt databærer-medium.

Artikel 4 – Tilbuddet

Hvis et tilbud har begrænset gyldighed eller særlige betingelser, angives dette udtrykkeligt.
Tilbuddet er ikke bindende; Fluxidi kan ændre det.

Tilbuddet indeholder en fuldstændig og præcis beskrivelse af produkterne og/eller tjenesterne. Billeder kan afvige lidt i farve fra virkeligheden.

Tilbuddet indeholder oplysninger, så forbrugeren tydeligt ved, hvilke rettigheder og forpligtelser der følger af at acceptere tilbuddet, herunder:

  • Eventuelle forsendelsesomkostninger.

  • Hvordan aftalen indgĂĄs.

  • Om fortrydelsesret gælder.

  • Betalings-, leverings- og udførelsesmetode.

  • Frist for accept af tilbuddet eller garanti for prisens varighed.

  • Information om eventuelle kommunikationsgebyrer.

  • Hvordan aftalen arkiveres, og hvordan den kan tilgĂĄs.

  • Hvordan forbrugeren kan kontrollere eller rette sine oplysninger.

  • Eventuelle andre sprog end dansk/nederlandsk.

  • Gældende adfærdskoder.

  • Minimumsvarighed ved langvarige aftaler.

Artikel 5 – Aftalen

Aftalen indgĂĄs, nĂĄr forbrugeren accepterer tilbuddet og opfylder de fastsatte betingelser.
Fluxidi bekræfter straks elektronisk modtagelsen af accepten.

Fluxidi iværksætter passende tekniske og organisatoriske foranstaltninger for sikker dataoverførsel.

Artikel 6 – Fortrydelsesret (for produkter)

Ved køb af produkter kan forbrugeren fortryde inden for 30 dage uden grund.
Produktet skal returneres inden 30 dage efter meddelelse til Fluxidi.

Fluxidi refunderer betalte beløb snarest muligt, dog senest 30 dage efter modtagelse af produktet i god stand.

Artikel 7 – Omkostninger ved fortrydelse

Returneringsomkostninger bæres af forbrugeren.

Artikel 8 – Udelukkelse af fortrydelsesret

Fluxidi kan udelukke fortrydelsesretten for visse varer, hvis det fremgår tydeligt før aftalens indgåelse, fx:

  • Varer fremstillet efter forbrugerens specifikationer.

  • Personlige varer.

  • Letfordærvelige produkter.

  • Hygiejneprodukter, hvor forseglingen er brudt.

  • Aviser, tidsskrifter eller downloadet digitalt indhold.

Artikel 9 – Pris

Priser for produkter og/eller tjenester ændres ikke i gyldighedsperioden, medmindre det skyldes lovbestemte ændringer i moms eller afgifter.

Artikel 10 – Overensstemmelse og garanti

Fluxidi garanterer, at de leverede produkter svarer til aftalen, beskrivelsen og almindelige krav til kvalitet og anvendelighed.
Eventuelle mangler skal meddeles skriftligt inden 30 dage efter levering.

Artikel 11 – Levering og udførelse

Fluxidi udviser størst mulig omhu ved modtagelse og udførelse af ordrer.
Levering sker inden 30 dage, medmindre andet er aftalt.

Ved forsinkelse informeres forbrugeren, som kan ophæve aftalen uden omkostninger.

Artikel 12 – Langvarige aftaler: varighed, opsigelse og forlængelse

Forbrugeren kan til enhver tid opsige aftaler af ubestemt varighed med en mĂĄneds varsel.
Aftaler af bestemt varighed kan ikke forlænges ud over den aftalte periode uden forbrugerens samtykke.

Artikel 13 – Betaling

Medmindre andet er aftalt, skal betaling ske inden 7 arbejdsdage efter fortrydelsesfristens begyndelse.

Artikel 14 – Klager

Klager skal indsendes skriftligt inden 7 dage efter, at manglen er konstateret.
Fluxidi svarer inden 14 dage fra modtagelse.

Hvis klagen ikke løses i mindelighed, behandles sagen som en tvist i henhold til artikel 15.

Artikel 15 – Tvister

Kun nederlandsk lov finder anvendelse pĂĄ aftaler mellem Fluxidi og forbrugeren, ogsĂĄ hvis forbrugeren er bosat i udlandet.

Article 1 – Definitions

In these terms and conditions, the following definitions apply:

Cooling-off period: The period during which the consumer may exercise their right of withdrawal.

Consumer: The natural person who does not act in the course of a profession or business and enters into a distance contract with Fluxidi.

Day: Calendar day.

Long-term transaction: A distance contract relating to a series of products and/or services whose delivery and/or purchase obligations are spread over time.

Durable data carrier: Any medium that enables the consumer or Fluxidi to store information addressed personally to them in such a way that future consultation and unaltered reproduction of the stored information is possible.

Right of withdrawal: The possibility for the consumer to withdraw from the distance contract within the cooling-off period.

Entrepreneur: Fluxidi, the natural or legal person offering products and/or services to consumers at a distance.

Distance contract: A contract concluded within the framework of a system organized by Fluxidi for the distance sale of products and/or services, whereby exclusive use is made of one or more means of distance communication.

Means of distance communication: Means that can be used for concluding a contract without the consumer and Fluxidi being simultaneously present in the same place.

General Terms and Conditions: These present Terms and Conditions of Fluxidi.

Article 2 – Right of Withdrawal

The consumer has the right to withdraw from the contract within a period of 30 days without giving any reason.
During this period, the consumer shall handle the product and its packaging with care.

If the consumer exercises the right of withdrawal, the product with all supplied accessories must be returned, if reasonably possible, in the original condition and packaging according to reasonable and clear instructions provided by Fluxidi.

Article 3 – Applicability

These general terms apply to every offer made by Fluxidi and to every distance contract concluded between Fluxidi and the consumer.

Before the distance contract is concluded, the text of these terms will be made available to the consumer in a manner allowing easy storage on a durable data carrier.

If one or more provisions in these terms are void or annulled, the remaining provisions shall remain in force.

Article 4 – The Offer

If an offer has a limited validity or is made subject to conditions, this will be expressly stated.
The offer is non-binding; Fluxidi is entitled to modify and adjust the offer.

The offer contains a complete and accurate description of the products and/or services. Images are intended as a true representation but colours may vary slightly.

Each offer includes information enabling the consumer to clearly understand the rights and obligations attached to acceptance of the offer, such as:

  • Any shipping costs.

  • The method of conclusion of the contract.

  • Whether the right of withdrawal applies.

  • The payment, delivery, and performance methods.

  • The period for accepting the offer or the period for which Fluxidi guarantees the price.

  • Information about communication costs if applicable.

  • Whether the contract will be archived and how it can be accessed.

  • How the consumer can verify or correct provided data.

  • Any available languages other than Dutch.

  • Applicable codes of conduct.

  • The minimum duration in case of long-term transactions.

Optional details may include available sizes, colours, or materials.

Article 5 – The Contract

The contract is concluded when the consumer accepts the offer and meets the stated conditions.
If the consumer accepts the offer electronically, Fluxidi shall promptly confirm receipt of acceptance electronically.

Fluxidi shall take appropriate technical and organizational measures to secure electronic data transfer and provide a secure web environment.

Fluxidi may investigate whether the consumer can meet payment obligations.

Fluxidi shall send, at the latest upon delivery, the following information on a durable data carrier:

  • The business address where complaints may be submitted.

  • Conditions for exercising the right of withdrawal.

  • Warranty details and after-sales service.

  • The information listed in Article 4.

  • The conditions for terminating long-term contracts.

Article 6 – Right of Withdrawal (for products)

Upon purchasing products, the consumer may withdraw within 30 days without stating a reason.

During the cooling-off period, the consumer shall handle the product with care. If the right of withdrawal is exercised, the consumer must notify Fluxidi in writing or by email and return the product within 30 days after notification.

If the consumer has paid an amount, Fluxidi will refund it as soon as possible, but no later than 30 days after withdrawal, provided the product has been received back in good order.

Article 7 – Costs of Withdrawal

The return shipping costs are borne by the consumer.

Article 8 – Exclusion of Withdrawal Right

Fluxidi may exclude the consumer’s right of withdrawal for specific products if clearly stated prior to the conclusion of the contract, for example:

  • Products made to the consumer’s specifications.

  • Products of a personal nature.

  • Perishable goods.

  • Sealed goods unsuitable for return due to health or hygiene reasons once unsealed.

  • Newspapers, magazines, or downloadable digital media.

Article 9 – Price

Prices of offered products and/or services will not be increased during the validity period, except for statutory VAT or legal changes.
All prices include VAT unless otherwise stated.

Article 10 – Conformity and Warranty

Fluxidi guarantees that the delivered products comply with the agreement, the specifications stated in the offer, and meet reasonable standards of reliability and usability.

Defects must be reported in writing within 30 days after delivery.

The warranty corresponds to the manufacturer’s warranty unless otherwise stated.

The warranty is void if:

  • The consumer has repaired or altered the products.

  • Products have been exposed to abnormal conditions or treated contrary to instructions.

Article 11 – Delivery and Execution

Fluxidi will exercise the greatest possible care when receiving and executing product orders.
Orders will be executed within 30 days unless otherwise agreed.

If delivery is delayed, the consumer will be notified and may cancel without cost. Refunds will occur within 30 days.

Article 12 – Long-Term Transactions: Duration, Termination and Renewal

The consumer may terminate a contract concluded for an indefinite period at any time with one month’s notice.
Contracts for a definite period may not be tacitly extended for more than the agreed duration.

Article 13 – Payment

Unless otherwise agreed, payments must be made within 7 working days after the cooling-off period commences.

Article 14 – Complaints Procedure

Complaints about the execution of the contract must be submitted within 7 days after defects are discovered.
Fluxidi will respond within 14 days after receipt.

If a complaint cannot be resolved by mutual agreement, it becomes a dispute subject to Article 15.

Article 15 – Disputes

Only Dutch law applies to contracts between Fluxidi and the consumer.
This also applies if the consumer resides abroad.
